Performance and Display

1.  Face-to-Face Teaching

Section 110(1) of Title 17 of the United States Copyright Law allows for "performance or display of a work by instructors or pupils in the course of face-to-face teaching activities of a nonprofit educational institution, in a classroom or similar place devoted to instruction."

 

2.  Distance Education - The TEACH Act

Section 110(2) of Title 17 of the United States Copyright Law applies to transmissions of performances or displays (ie. distance education/online classes).  This section was updated by the Technology, Education, and the Copyright Harmonization Act of 2002 (TEACH Act).  However, in order to qualify for exceptions under the TEACH Act there are several requirements that must be met.
